Welcome to Vaistoa's online store. By accessing and using our website, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before making any purchases or using our services.

1. GENERAL

These general terms and conditions contain the terms and conditions for the use of the online service provided by Kipu Solutions Oy (hereinafter referred to as the "Service Provider") as well as the terms and conditions for ordering and delivering products and services. These general terms and conditions apply to the online service maintained by Kipu Solutions Oy (www.vaistoa.com).

By using the Service, the user of the Service (hereinafter referred to as the "Customer") accepts these general terms and conditions and agrees to comply with them.

The Service Provider has the right to change these general terms and conditions. The Customer accepts the changes by using the Service. The currently valid terms and conditions are available on the Service Provider's website (www.vaistoa.com).

In online services, the Customer's personal data is processed in accordance with data protection legislation and the privacy policy of Kipu Solutions Oy.

2. CONTENT OF SERVICES

The services include those provided by Kipu Solutions Oy and any potential partners, including materials and the current product range of the online store. The services offer, among other things, the opportunity to participate in surveys, competitions, and the company's service and product development programs.

The services provided by the Service Provider and other content are intended for the Customer's personal and non-commercial use only.

The entire content of the services, including images, logos, product information and other texts, videos, tables, trademarks, and brands, is protected property under copyrights and other intellectual property rights owned by Kipu Solutions Oy and/or its partners. All intellectual property rights to the content belong to the Service Provider or its partners.

The services may use technologies that require the installation of applications and additional features provided by third parties. The Service Provider is not responsible for the functionality of third-party applications and add-ons installed by the Customer, for any disruptions or errors they cause, or for any other related damages.

The services may contain links to sites owned or maintained by third parties. The Service Provider is not responsible for the content, operation, or other features of such third-party sites.

The Service Provider does not guarantee uninterrupted and error-free operation of the services. Unless otherwise stipulated by mandatory regulations, the Service Provider is not liable for any direct, indirect, or incidental damages resulting from the use or inability to use the services. The Service Provider reserves the right to modify, change, or remove parts of the services at any time without prior notice.

3. USE OF THE SERVICE

The Customer is responsible for ensuring that they do not produce, send, store, or otherwise handle material through the Service that infringes on copyrights or other rights, laws, or regulations set by authorities. The Customer is liable for any damages resulting from copyright or other rights infringements, and such infringements may also lead to criminal consequences.

By producing any content (such as text) for the Services, the Customer agrees to grant the Service Provider a full, irrevocable, free, non-exclusive right to use such content for any purpose in any manner.

To enable the Service Provider to use the content produced by the Customer, the Customer hereby warrants that (i) the content produced by the Customer is the result of the Customer's original work and does not violate any applicable laws; and (ii) the Customer has the right to grant the Service Provider the right to use the content as described above.

By sharing any content on the Service, the Customer agrees to indemnify the Service Provider against all claims, costs (including reasonable defense costs), damages, losses, and liabilities made by third parties arising from the presentation of the content produced by the Customer.

4. PURCHASING AT ONLINE STORE

You can purchase products at our online store if you are over 18 years old. After making the order and accepting these terms and conditions, you get a binding order confirmation by e-mail. Vaistoa.com reserves the right to change prices and terms and conditions case by case.

The Customer is responsible for his/her own account and password. The buyer is responsible for giving the correct information when making the order.

The Customer is responsible for the actions taken while logged in with their username and ensures that their activities comply with these Terms and Conditions.

5. SHIPPING AND DELIVERY

Products are delivered to the customer as a shipping service from the warehouse in Finland. The delivery time for products is usually about 3-7 business days (public holidays may affect delivery time). Products from a single order can be delivered in multiple shipments if necessary.

Updated information on delivery methods, delivery countries, and delivery costs can be found under the Shipping Policy. Shipping costs will be calculated at checkout and are dependent on the delivery location and shipping method selected.

The Customer is responsible for ensuring that the information provided in their order and customer details is correct.

The Service Provider is not responsible for delivery delays caused by factors beyond the online store's control.

The Service Provider is not responsible for delays or damages caused by an event of force majeure, extraordinary event or circumstance beyond its control.

6. PRICING AND PAYMENT METHODS

The prices of products and services include VAT but do not include delivery costs unless otherwise stated.

Delivery costs for the product are calculated and paid at the time of ordering.

The price of a product is the one that shows in the online store at the moment of purchasing. Possible extra delivery and payment fees are shown at the checkout. The prices of products and services are determined according to the The Service Provider reserves the right to change the product price at anytime.

The service provider reserves the right to cancel the order in case of obvious pricing errors, in other words when the declared price differs significantly from the actual price of the product.

Only one discount code can be used per order. Different discounts cannot be combined.

The Customer can pay for the product or service only using the payment methods currently accepted by Kipu Solutions Oy. The payment methods are specified in detail at the checkout.

7. RETURNS AND RIGHT TO CANCEL

The products have a 90-day free return policy if the return is made according to the Service Provider's instructions. The return period for products starts from when the goods are received or when the delivery is available for collection by the Customer. The Customer must register the return, after which they will receive instructions via email for returning the product. See our return policy for updated information.

The return policy applies only to unused and resalable products in their original packaging. The product should not be used before the decision to keep it is made. The consumer must keep the product substantially unchanged and undiminished until the decision to keep the item is made. Therefore, the products must be intact, unwashed, and unused, without any odors, hairs, or other signs of use. Shoes may only be tried on indoors during fitting. The return must include the original packaging and all parts, documents, and packaging materials that came with it.

The Customer is fully responsible for any costs arising from incorrect or incomplete returns. Returns must always be made from the same country where the order was originally delivered, and returns sent from other countries cannot be accepted.

The Service Provider will refund all payments received from the Customer for returned products, including any delivery costs, within 14 days of receiving the returned products back to the warehouse.

If the delivery of the Customer's order was free and after a partial return, the total amount falls below the free delivery threshold, the delivery costs will be deducted from the refund.

Each order includes one free return. If products from the same order are returned in more than one shipment, the Service Provider reserves the right to charge €14.90 for each additional return shipment to cover handling and return costs.

Failure to collect the goods or refusal to accept delivery is not considered a valid cancellation or return within this context.
In such cases, a minimum fee of €24.90 will be deducted from the refund amount to cover the actual return shipping and any applicable customs or handling costs incurred.

8. RESPONSIBLE USE AND ORDER LIMITATIONS

The Service Provider is committed to maintaining a fair and sustainable shopping environment for all customers. To achieve this, the Service Provider may review and evaluate order and return activities, including but not limited to cases where multiple similar products are purchased and returned in unusually large quantities, several overlapping orders are placed within a short period of time, or promotional benefits are repeatedly used in a manner inconsistent with normal consumer behavior.

If such activity is identified and is deemed to materially deviate from normal purchasing patterns or indicate misuse of the return or promotional programs, the Service Provider reserves the right to restrict or cancel future orders, withdraw eligibility for free returns, or suspend access to discounts and other promotional benefits.

These measures may be applied automatically within the Service Provider’s systems to ensure the fair use of services, prevent logistical misuse, and reduce unnecessary environmental impact resulting from excessive returns.

Customers planning unusually large purchases are advised to contact the Service Provider in advance to ensure efficient handling and appropriate product selection.

These measures do not affect the Customer’s statutory rights under applicable consumer protection laws

9. PRIVACY AND PERSONAL DATA

We collect personal information necessary for processing your order and improving our services. Information collected will be used for order processing, customer service, and marketing purposes, in compliance with applicable privacy laws.

Personal data will be retained for as long as necessary to fulfill the purposes for which it was collected. Customers have the right to access, correct, and request the deletion of their personal data. See our Privacy Policy for more information.

10. LIABILITY

The service provider is not liable for any indirect, special, or consequential damages arising out of or in connection with the use of our products.

Our liability for any claim related to a product is limited to the purchase price of the product.

11. GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Finland.
